It has been decided by English judges, that 'to be born alive,' means, that acts of life must have been manifested after the whole body has been extruded; and that respiration in transitu is not evidence that a child was born alive. It must be 'wholly born alive;' hence respiration may be a sign of life, but not of live birth.
